DATED : SEPTEMBER 16, 2016 By this contempt petition, the petitioner has sought action against the respondent for wilfull disobedience of the order dated 11/9/2015 in Writ Petition No. 4724/2015.
It is stated on behalf of the petitioner that though the petitioner had filed an application for mutation before the Tahsildar and the Tahsildar was directed to decide the application within three months from the date of receipt of the application, the Tahsildar has not decided the application.
Shri Tembhare, learned Assistant Government Pleader appearing for the respondent, states that the application of the petitioner is decided on 16/9/2016 and the same is rejected. It is stated that the delay caused in deciding the application is due to the fact that the respondent was holding the charge of two posts at the relevant time and, therefore, she was over
2/3 burdened.
In view of the statements recorded hereinabove, it would not be proper to proceed with the contempt petition any longer. The contempt petition is, therefore, disposed of with no order as to costs. JUDGE JUDGE khj
