Shri A. B. Nakshine, learned counsel appearing for non applicant no. 2 states that non applicant no.1 had executed a registered will deed in the name of non applicant no. 2 on 04.01.1998. He has furnished the copy of said will. Same is taken on record and marked 'X' for identification.

In view of aforesaid Shri A. B. Patil learned counsel for the appellant seeks permission to delete the name of non applicant no. 1. Permission granted.

Prayer is to condone delay in filing first appeal. For reasons stated in the application delay in filing first appeal is condoned. Civil application is allowed.
