When this Court was not inclined to interfere on the ground that the case of the petitioner was already referred to the Appellate Medical Board in terms of the Rule 29-J of the Mines Rules, 1955, the learned counsel for the petitioner, upon instructions seeks permission to withdraw the petition, with liberty to appear before the Appellate Medical Board. 2) The petition is therefore dismissed as withdrawn. Since the matter is already referred to the Appellate Medical Board by the respondent, we direct that the same shall be constituted as early as possible and not later than four weeks from today and the petitioner be examined.
