The application is opposed by the learned counsel for the appellant.

Prima facie, considering the evidence on record, 50% of the amount of compensation as deposited is permitted to be withdrawn subject to filing undertaking within period of eight weeks that in case the appeal is allowed, same shall be repaid with interest at such rate the Court may direct. Remaining amount shall be invested in Fixed Deposit. Civil Application is disposed of. First Appeal No.1317 of 2017 The private paper-book is permitted to be filed within period of ten days from today.
