APRIL 3, 2017 The respondent no.2-complainant is present with her counsel Mr. Bastian. The petitioners are also present with their counsel Mr. Agrawal. The learned A.P.P. appears for the respondent no.1.

The parties jointly state that the matrimonial discord which led to Section 498-A Indian Penal Code prosecution, has been amicably settled by them. In the Petition No.A-38/2012 filed before the Family Court No.2, Nagpur, the judgment has been delivered on 18.01.2017 and the marriage has been dissolved by a decree by mutual consent.

It is agreed that the present proceedings shall be withdrawn by the respondent no.2 and the amount deposited in the office of the Family Court can thereafter be withdrawn by her.

crwp242.17.odt In view of this joint statement and request, we make rule absolute in terms of prayer clause (i). Accordingly, the First Information Report No.96/2012 under Section 498-A read with Section 34 of the IPC and Sections 3 and 4 of the Dowry Prohibition Act so also Charge Sheet No.96/2012, presented to the court of Additional Chief Judicial Magistrate, Nagpur and Regular Criminal Case No.1687/2012, registered on that basis are quashed and set aside.

The criminal writ petition is disposed of accordingly.
