By this petition, the petitioners have challenged the registered list of owners of the machines prepared for allotment of works in the matter of soil conservation etc. for the year 2014-15 and a direction is sought to the respondents to prepare a fresh list of registered owners of the machines for allotment of the work, in accordance with law.

Shri Khubalkar, the learned Assistant Government Pleader appearing on behalf of the respondents, states that the Government has now decided to discontinue the practice of maintaining the registered list of owners of machines for allotment of the works. It is stated that since the Government has decided not to maintain the registered list of owners of the machines, the cause for filing the writ petition would not survive.

In view of the statement made on behalf of the respondents, we find that the cause for filing the writ petition would not survive. If the petitioners are aggrieved by the allotment of works to the undeserving owners of machines, the petitioners are free to take appropriate action, in accordance with law.

In the result, the writ petition is disposed of, with no order as to costs.
