1107cp100.16 1/2
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
NAGPUR BENCH : NAGPUR CONTEMPT PETITION NO.100 OF 2016 IN PUBLIC INTEREST LITIGATION NO.50 OF 2012 (Anil s/o Shamsunder Agre vs. Shri Shardaprasad Yadav, Commissioner of Police and another) __________________________________________________________________ Office Notes, Office Memoranda of Coram, appearances, Court's orders Court's or Judge's orders or directions and Registrar's orders.
Shri S.P. Bhandarkar, Advocate for petitioner. Smt. B.H. Dangre, Government Pleader for respondents.
---------- CORAM : B.P. DHARMADHIKARI AND KUM. INDIRA JAIN, JJ.
DATED : JULY 11, 2016 Heard for some time.
Effort of Adv. Bhandarkar for petitioner is to demonstrate violation of Court's orders.
Smt. Dangre, learned Government Pleader has pointed out that in most of the cases, action in accordance with law has been taken.
After hearing respective Counsel, we find that there are some Transport Offices in the area and those transporters or vehicles coming to their offices/ garages violate Court's orders.
Thus, merely by demonstrating that a vehicle is parked, though violation of Court's orders
1107cp100.16 2/2 may be demonstrated, it may not be possible to reach real culprit.
The petitioner, therefore, has to prepare a chart pointing out the various vehicles with their registration numbers and other details so that they can demonstrate the Court as also Officers of the State Government that vehicles of same owner were parked on more than one occasion and owners have been punished for violating parking law or for violating Court's orders.
The petitioner has to bring on record material showing that transporters, who are aware of Court's orders are not bothered about the same and permit the same to be violated. Hence, with liberty to petitioner to place before respondents such data for due evaluation and with direction to respondents to take prompt action if such data is placed before them, we dispose of the contempt petition. No costs. JUDGE JUDGE khj
