IN THE HIGH COURT OF JUDICATURE AT BOMBAY

NAGPUR BENCH : NAGPUR WRIT PETITION NO. 350 OF 2021 Ravindra s/o Motiramji Vaidya and anr.

-- Petitioners vs.

State of Maharashtra and others --Respondents Mr. S. S. Dhengale, Advocate for Petitioners. Mr. A. A. Madiwale, AGP for Respondent Nos.1, 3, 4 and 6. CORAM : NITIN JAMDAR & ANIL S. KILOR, JJ.

DATE : 23 FEBRUARY 2021 P. C. :

This Petition is filed by two persons residing in different wards in the jurisdiction of Municipal Council, Mowad, Tahsil - Narkhed, District - Nagpur.

2.

The Petitioners ought to have file separate petitions, as they are desirous of contesting elections from different wards and they are questioning the reservation in different wards. Since the Petitioners are desirous of contesting the election, unless they demonstrate that if the reservation is properly applied following the rotation, it would enable the Petitioner to contest the election, the challenge would be only an academic. We do not find any assertion in the petition to that effect.

The learned counsel for the Petitioner states that the Petitioners will file separate petitions focusing upon the wards from which they seek to contest and demonstrating that correct application of reservation would entail them to contest the election.
