DATE : 31/03/2023 The question whether the respondent no.1 is a member of the Trust or not has not been gone into by the learned Assistant Charity Commissioner in the impugned order (pg.38). The application for intervention has been allowed on the ground that there is material placed on record to indicate some interest in the respondent no.1. Since the petitioners, who were having best evidence, in the form of membership of the society, to oppose the application, which has not been placed on record, I do not see any reason to interfere in the impugned order. The writ petition is dismissed. No order as to costs.
