The learned A.P.P. upon instructions makes a statement that the prosecution has examined all the witnesses, except the investigating officer, who is today present before the trial Court for recording evidence. The learned A.P.P. has re-assured from the concerned P.P. and made a statement that the said investigating officer is the only witness the prosecution desires to Rgd.

In the wake of such position, we are not inclined to entertain the bail plea of the appellant, as the trial is at the fag end. In view of above, Criminal Appeal is disposed of with a liberty to approach this Court again, if the trial is not completed within a period of three months.

We also direct the trial Court to dispose of the trial within a period of three months. Registry to inform the concern.

Fees of the Advocate appointed for respondent no.2 be paid as per Rules.
