This is the second application for regular bail. However, no change in the circumstances is pointed out. Mr. Wakode, the learned counsel for the applicant, has filed on record, by way of additional affidavit, that the Sessions Trial is fixed on 08.06.2016 for framing of the charge. Speedy trial is the right of the accused who is languishing in the jail.
In that view of the matter, it will be expedient to meet the ends of justice to direct the Court below to expedite the trial. Hence, the following order is passed.
ORDER
Criminal Application No.223/2016 is dismissed as there is no change in the circumstances. However, the learned Additional Sessions Judge, Malkapur, on whose file the Sessions Trial No.18/2015 is pending, is hereby directed to give precedence to the present Sessions Trial and shall take suitable steps to complete the Sessions Trial within a period of nine months from the date of receipt of this order.
