The learned APP brought to our notice a decision of this Court in case of L&T Finance Limited Vs. State of Maharashtra and others, (2023) 1 High Court Cases (Bom) 173 which reflects a Government Circular (para 17) providing a mechanism for the redressal of secured creditor by way of approaching to the Divisional Commissioner. Clause (iv) of the said Circular covers implementation of order passed under Section 14 of the Secularisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 also. 3.

In view of above, the petitioner seeks permission for withdrawal with liberty to approach the authority in terms of above mentioned government circular.
