DATED : 25/09/2020 1] By this application, the appellant - convict has prayed that the order passed by this Court on 09/03/2020 appointing amicus curiae to represent the appellant be recalled and Shri A.M. Wasnik, Advocate be permitted to represent the appellant.

2] In the criminal application which is not supported by affidavit but signed by Shri A.M. Wasnik, Advocate, it is stated that on 09/03/2020 when the order came to be passed by this Court appointing amicus curiae, the mother-in-law of Shri A.M. Wasnik, Advocate was seriously ill and therefore Shri A.M. Wasnik, Advocate could not attend the matter on 09/03/2020. It is stated that mother-in-law of Shri A.M. Wasnik, Advocate expired on 15/03/2020.

appa243.2020 3] Accepting the explanation given in the application, the order passed by this Court on 09/03/2020 is recalled and the appointment of amicus curiae is cancelled. 4] Shri A.M. Wasnik, Advocate undertakes to represent the appellant - accused and argue the appeal on the next date.

5] The criminal application is allowed accordingly. CRIMINAL APPEAL NO. 422/2016 6] Shri A.M. Wasnik, Advocate requests that the appeal be taken up for final hearing in the first week of October, 2020.

7] Office is directed to list the appeal in the first week of October, 2020.
