DATED : JULY 18, 2019 This appeal was filed by appellant, challenging the judgment and order of conviction passed by learned Additional Sessions Judge, Akola in Sessions Trial No.62/2001 dated 02.11.2006. By the said, the appellant was convicted for the offence punishable under Section 307 of the Indian Penal Code and was directed to undergo rigorous imprisonment for five years and to pay a fine of Rs.2,000/-.

The appeal was admitted on 26.04.2007 and on the same day, by suspending substantive jail sentence, the appellant was released on bail.

On 11.07.2019, counsel for appellant informed to the Court that the appellant-Dinkar Jawanjail passed away. Today, learned A.P.P. Mr. Ukey submitted that he has a written instruction from Police Sub Inspector, Police Station, Patur that appellant Dinkar died on 08.12.2013. He submitted that the death certificate issued by the Registrar,
