Heard Shri Rajnish Vyas, learned counsel for the applicants and Shri S.D. Palshikar, learned APP for the nonapplicant. 2.

The parties to matrimonial dispute are jointly before this Court with a prayer to quash and set aside Regular Criminal Case and First Information Report, on the basis of which it has started. Applicant No. 1 is the husband and applicant No. 8 is the wife.

Applicant No. 1 and applicant No. 8 are present and are identified by their counsel. Similarly, other applicants except applicant Nos. 4 & 5 are also present. 4.

Applicant No. 3 states that the marriage with applicant No. 1 is being dissolved and she has to receive an amount of Rs.2.5 lakh and out of it an amount of Rs.1.5 lakh is already received by her and the balance amount is deposited with the Court of Joint Civil Judge, Senior Division, Nagpur. She, therefore, submits that Criminal proceedings which have begun because of the complaint lodged by her, may be put to an end.

In view of express request and the terms reached between the parties, we make the rule absolute in terms of prayer clause (i). Criminal Application is accordingly allowed and disposed of. No order as to costs. JUDGE JUDGE *GS.
