The learned Advocate for the appellant has submitted that the averments made in paragraph No.5 of the application are false. It is further submitted that the appellant / insurance company is disputing the fact that the vehicle involved in the accident was insured with the appellant / insurance company. Considering the facts of the case, prayer of the applicant / respondent No.1 for withdrawal of amount cannot be granted. The civil application is dismissed. No costs.
