It is not in dispute that the applicant was arrested on 15-3-2015 for the offences punishable under Sections 354, 452, 323 and 506 of the Indian Penal Code read with Sections 7 and 8 of the Protection of Children from Sexual Offence Act and is in jail since then. It is not in dispute that investigation has been completed and charge-sheet has been filed before the competent Court. Looking to the nature of offences and the period spent by the applicant in jail, I think the following order would sub-serve the interest of justice.

ORDER

(i) Criminal Application No. 213/2015 is allowed. (ii) The applicant be released on his furnishing personal bond of Rs. 5,000/- with one solvent surety in the like amount.

(iii) The applicant shall not enter the Village Usagaon, Tahsil and District Chandrapur.

(iv) Liberty is granted to the applicant to apply for modification of this order after three months. JUDGE wasnik
