DATE : 16/07/2020 Hearing was conducted through Video Conferencing and the learned Counsel agreed that the audio and visual quality was proper.
Heard Shri Thakur, learned Counsel for the applicant. The applicant is charged for an offence under Sections 302, 307, 323 read with Section 34 of Indian Penal Code in Crime No.774/2018. The learned Counsel for the applicant submits that no overt action, except for catching hold of the hands of the deceased, has been attributed to the co-accused, who has been released on bail. The assault due to which the deceased passed away, has been attributed to the applicant. There are as many as six eyewitnesses, who have witnessed the applicant, assaulting the deceased.
