This is an application for condonation of delay which is strenuously objected by the claimants as according to them, delay is not properly explained.

In paragraphs 4 and 5, the reasons are furnished justifying the delay which appear to be germane to the cause. That being so, the delay of 114 days in filing the appeal stands condoned. FIRST APPEAL ST. NO.6228/2018.

Learned counsel Shri S.R. Charpe waives notice of hearing on behalf of the respondent nos.1 to 4.

Paper book be filed within six months from today, failing which the appeal would stand dismissed without further reference to the Court.

As the entire amount of compensation with interest is deposited, there shall be stay to the execution of the impugned judgment.

The application is allowed in terms of prayer clause (1) with liberty to the non-applicants to apply for withdrawal of the amount deposited by the applicant.
