DATE : 6.4.2016 Heard Shri R. M. Daga, advocate for the applicant and Shri S.B. Bissa, A.P.P. for the non-applicant.

The applicant is arrested on 25 th August, 2015 in crime registered against him and his two sons for the offence punishable under Sections 307, 504, 302 read with 34 of the Indian Penal Code.

According to the prosecution, the applicant and his two sons assaulted the driver of a taxi as taxi had given dash to the cow owned by the applicant. According to the prosecution, the applicant caught hold of the victim and applicant's sons Sachin assaulted

The charge-sheet is filed. The co-accused Aakash is granted bail by this Court by the order dated 16 th March, 2016. The non-applicant has not been able to show that the custody of applicant is required for further investigation. Considering the facts on the record, I am of the view that the applicant is entitled to be released on bail. Hence, the following order:

(i) The applicant having been arrested in Crime No.218/2015 registered by the non-applicant, the applicant be released on bail on furnishing P.R. bond for Rs.20,000/- (Rs. Twenty Thousand Only) and one solvent surety in the like amount.

(ii) The application is allowed in the above terms. CRIMINAL APPLICATION (APPP) NO.375/2016 In view of disposal of main application, this application does not survive and is disposed of accordingly.
