Criminal Application was dismissed for want of prosecution since there was no appearance on 1.2.2018 and thereafter on 15.2.2018.

The application for restoration does not even attempt to explain why none appeared on 1.2.2018. In so far as absence on 15.2.2018 is concerned, the absence is attributed to the counsel being out of station. The application is not supported by the affidavit of the counsel. There is no ground made out for restoration. However, since the applicants should not suffer due to apathy of the counsel, the application is restored subject to payment of cost of Rs. 1,000/- to be deposited with the High Court Legal Aid Sub-committee, Nagpur.
