By this petition, the petitioner seeks a direction to the respondent no.3 - Joint Director of Health Services to decide the representation made by the petitioner for initiating the selection process for filling the vacant posts in the Public Health Department of the State Govt. The relief sought by the petitioner cannot be granted in exercise of the writ jurisdiction. It would not be within the domain of this Court to direct the State Govt., or its authorities to immediately fill up the vacant posts in the Health Department. It would be for the State Govt., to consider the relevant circumstances and then initiate the process of selection. If the prayer made
in the representation cannot be granted, a direction to decide the representation cannot be issued.
Since the relief sought by the petitioner, by the representation, cannot be granted in favour of the petitioner, the Writ Petition is dismissed with no order as to costs.
