By this writ petition, the petitioner challenges the voters list prepared by the respondent No.1, dated 20/02/2016 as bad in law. A direction is sought against the respondent No.1 to prepare a fresh voters list.

Shri Ambarish Joshi, the learned Assistant Government Pleader appearing for the respondent Nos.1 and 2, states that the elections to the Society are declared and the same are scheduled on 30/04/2016. It is stated that the petitioner would have a right to file an election petition and it would not be proper to consider the prayers made in the writ petition after the election programme is declared. We uphold the preliminary objection raised on behalf of the respondents Nos.1 and 2.

By keeping the points raised in the writ petition open, we dispose of the writ petition with no order as to costs. JUDGE JUDGE KHUNTE
