The challenge in the petition is to the order dated 23.12.2015 whereby the tribe claim of the petitioner as that of belonging to 'Halba' Scheduled Tribe came to be rejected by the Scrutiny Committee. 3.

The challenge to the impugned order dated 23.12.2015 is not pressed and that being so, the writ petition to the aforesaid extent stands dismissed. 4.

Our attention is invited to the fact that the petitioner was appointed way back on 24.03.1988 and in view of the existing policy of the State Government, her services deserve to be protected by absorbing her on supernumerary post.

In the aforesaid backdrop, we deem it appropriate to direct the petitioner to make a representation to the Chief Executive Officer, Zilla Parishad, Nagpur, for absorption of her services on supernumerary post. 6.

In case, if such representation is made by the petitioner, the same be considered and decided within a period of three months thereafter. 7.

Till such decision is communicated to the petitioner, status quo shall be maintained as regards the services of the petitioner. (VRUSHALI V. JOSHI, J.) (NITIN W. SAMBRE, J.) Andurkar.
