Heard.

We do not find that the view taken by the learned Maharashtra Administrative Tribunal can be said to be erroneous so as to warrant interference with the impugned order. On the contrary, we find that the view taken by the learned Tribunal is in more tune with sound common sense. Undisputedly, on the date on which the respondent had applied and on the date on which he was interviewed, he was having a valid non-creamy layer certificate. Rejected.
