M. S. Deogade, Advocates for petitioner are continuously absent from the Court from 08.12.2020. Respondent nos. 1 and 2 are represented by learned A.P.P. Detailed reply dated 02.05.2019 was already filed by them after giving copy of same to Mr.A.K.Bhangde, Advocate. On 29.12.2020, Commissioner of Police, Nagpur City filed his own affidavit in nature of affidavit in reply. Respondent no.2, by exercising powers conferred by Sub Section (2) of Section 3 of the Act of 1981, passed an order on 17.12.2018 directing that the petitioner be detained. The said order was communicated to the petitioner. The said was forwarded to the State Government for its approval and the State Government vide order dated 24.12.2018 approved the order of detention. The State Government forwarded the said

crwp221.19.odt order of detention for reference to the Advisory Board as contemplated under Section 10 of the Act, 1981 and the Advisory Board forwarded its report to the State Government. The State Government on 25.01.2019 passed the order of detention of the petitioner for one year as contemplated under Section 12 of the Act of 1981. The petitioner, after completion of his detention period was released by the authority on 19.12.2019. Probably that must be the reason for the learned counsel for the petitioner not to remain present from 08.12.2020 till today.

Since the petitioner is already released form detention, now nothing survives in this petition. The petition is, therefore, disposed of as such.
