By this petition, the petitioner has challenged the tender process and has sought a direction to the respondents to accept the technical bid of the petitioner so as to enable the petitioner in participating for the financial bid.

Mrs. Dangre, the learned Government Pleader appearing on behalf of the respondents, states that the respondents are desirous of withdrawing the tender and floating a fresh tender, as per the requirement. It is stated that if the tender, dated 18.2.2014 is called off, the grievance of the petitioner would not survive. Shri Purohit, the learned counsel for the petitioner, states that since the respondents would float a fresh tender by withdrawing the tender, dated 18.2.2014, the grievance of the petitioner would not survive.

In view of the statement made by the learned Government Pleader, which would be binding on the respondents, we dispose of the writ petition, with no order as to costs.
