Heard learned counsel for both sides.

By means of this Application, the applicant has sought leave to file Appeal against the order dated 29th August, 2017 delivered by learned 25th Judicial Magistrate, First Class, Nagpur, dismissing the complaint in default filed by the applicant under section 138 of the Negotiable Instruments Act.

I have considered the grounds of challenge mentioned in the Appeal and I am satisfied that a case is made out for grant of leave. Hence, leave is granted.
