The applicant is challenging First Information Report No.149/2022 registered with Yashodhara Nagar Police Station, Nagpur for offences punishable under Sections 376(2) (n), 406 and 506 of the Indian Penal Code.

Heard learned counsel Shri Abdul Subhan for the applicant and learned Additional Public Prosecutor for the State. Also, perused entire First Information Report. 3.

The First Information Report clearly spells out offences for which the applicant is booked.

This is not a fit case wherein the Court should take its discretion in favour of the applicant. However, it is a case wherein an opportunity should be given to the prosecution to conduct trial.

The criminal application is rejected and disposed of accordingly.
