DATED : 21-04-2016 Heard Shri I.S. Charlewar, Advocate and Shri F.T. Mirza, Advocate for the applicants in these two applications and Shri S.S. Doifode, Additional Public Prosecutor for the non-applicant.

The applicants apprehend arrest in crime registered against them for offences punishable under Sections 420, 468 and 471 of the Indian Penal Code accusing that the applicants have produced bogus and fabricated tax receipts before the Nazul Officer, on the basis of which the lease is renewed in the name of Anurag Madhusudan Agrawal-the applicant in Criminal Application (ABA) No.179/2016. The facts on record show that the alleged forged receipt is for an amount of Rs.676/-.

The non-applicant has not been able to show that the applicants are not co-operating with the investigation and that custody of the applicants is required for further investigation.

Considering the facts on record, in my view, the applicants are entitled for pre-arrest bail.

Hence, the following order :

i) In the event of arrest in Crime No.35/2016 registered by the non-applicant, the applicants be released on bail, on furnishing P.R. Bond for Rs.10,000/- each.
