Date : 3 rd May, 2016 Shri M.B. Naidu, the learned counsel for the appellant/applicant, seeks permission to join the Collector, Nagpur, as the party-respondent No.4 in this appeal, as the Authority under the provisions of the Land Acquisition Act. Permission is granted. Necessary amendment be carried out forthwith.

Shri M.A. Kadu, the learned AGP, waives service of notice for the added-respondent No.4 - the Collector, Nagpur. The Collector, Nagpur, is directed to deposit the balance amount of award in this Court within a period of eight weeks from today.

In view of the fact that the respondent Nos.1 to 3 have

0305caf1252.16.odt already withdrawn an amount of Rs.6,07,086/-, the balance amount to be deposited in this Court shall be kept in fixed deposit initially for a period of three years, to be renewed subsequently pending the decision of the appeal. Whosoever succeeds in the appeal, shall accordingly get the amount along with the interest, which shall accrue on such deposit. In view of this, Civil Application No.1252 of 2016 is allowed in the aforesaid terms and disposed of. The hearing of the appeal is expedited.

The appellant to file a private paper-book within a period of six months from today.
