Heard.

Perused the charge-sheet and reply of the prosecution. The investigation is over. The applicant is a permanent resident of Goregaon, Gondia and appears to have roots in the society. This application has been opposed only on the ground that this applicant may possibly tamper with the prosecution witnesses. However, the apprehension can be taken care of by imposing suitable conditions. Besides, the prosecutrix is a woman of 34 years of age and appears to be having good experience of life and, therefore, the possibility of influencing her by the witnesses cannot be inferred so easily. The allegations made by the prosecutrix, prima facie, would also indicate that after the investigation is over, requirement of detaining any further this applicant may not be there.

ba.259.18 2/2 Hence, the application is allowed and it is directed that the applicant be released on bail on his furnishing a P.R. Bond of Rs.50,000/- together with two solvent sureties in the like sum on the following conditions :

i.

The applicant shall attend the Police Station on every Sunday between 05:00 p.m. and 06:00 p.m. till the trial is over.

ii.

The applicant shall not tamper with the prosecution witnesses in any manner.

iii.

The applicant shall co-operate with the trial Court in expeditious disposal of the case.
