DATED : 08/03/2021 By this application, deletion of respondent no.3 is sought on the ground that the petitioner does not seek any relief as against the respondent no.3, which is the position as reflected from the prayer clause in the petition.

Learned counsel for the petitioner also admits that the relief in the petition is for issuance of the sale certificate as per the Maharashtra Land Revenue Code in respect of the land allotted to the petitioner, which under the provisions of the Maharashtra Land Revenue Code can only granted by the State of Maharashtra the respondent no.1 through the collector, respondent no.2.

(2) 7.caw.1457.2019 In view of this, respondent no.3 is neither a proper or necessary party to the petition, as the result of which, the Civil Application is allowed.

The respondent no.3 be deleted from the array of the respondents.
