The applicant has filed this application to seek transfer of the divorce proceedings filed by the nonapplicant vide Petition No.A/344/2024 pending before the Family Court, Akola to the Civil Judge Senior Division, Buldhana.

The learned Counsel for the applicant has stated that both the applicant and the non-applicant are Doctors by profession and they are Government servants. The applicant is staying at Chikhli, District Buldhana with her 10 years old son, who is taking education at Chikhli, District Buldhana. The applicant has stated that the distance from Buldhana to Akola is 100 kilometers and it is inconvenient for her to travel by taking leave. 3.

The non-applicant is not doing job in Akola. He is staying at Amravati as his job is at Amravati, which is 100 k.m. away from Akola. The non-applicant can travel from Akola to Amravati and the applicant can travel from Akola to Buldhana to attend the Court.

The learned Counsel for the non-applicant has stated that the non-applicant is having house in Akola. He has to take instructions whether the non-applicant is staying in Amravati or not. According to him, the applicant can travel from Buldhana to Akola, which is at a distance of 100 k.m. The applicant is doctor and there is no need of any escort for traveling to Akola. Hence, prayed to reject the application.

The applicant is staying with her son at Chikhli. The petition is filed by the non-applicant at Akola, however, he is not staying at Akola and he has to travel from Amravati to Akola which is at a distance of 100 k.m. As it is convenient for non-applicant to travel to Buldhana, the divorce proceeding vide Petition No.A/344/2024 which is pending before the Family Court at Akola, is transferred to the Civil Judge Senior Division, Buldhana. 7.
