The applicant was arrested for the offences punishable under Sections 354-A(2), 354-D(2), 506 of the Indian Penal Code and Section 11(4) and 12 of the Protection of Children from Sexual Offences Act and is in jail since the date of arrest i.e. 13-3-2015.

Learned APP pointedly stated that the applicant harassed the girl studying in 11th Standard by going to her college. There is strong evidence against the applicant and there is likelihood of applicant again harassing her. Undoubtedly, there is a substance in submission of learned APP. But then the fact remains that the applicant is in jail since 13-3-2015 and on his behalf, learned counsel for the applicant submits that the applicant will reside in Gondia till the trial is over and would not visit Warud, Tahsil Rajura,

2 ba218.15 District Chandrapur. That being so, I make the following order.

ORDER

(i) Criminal Application (BA) No. 218/2015 is allowed.

(ii) The applicant be released on bail on executing his personal bond of Rs. 5,000/- with one solvent surety in the like amount.

(iii) The applicant shall not enter the Village Warud, Tahsil Rajura, District Chandrapur.

(iv) The applicant shall report to the Police Station in Gondia in whose jurisdiction he will reside, on last Sunday every month between 11.00 a.m. to 4.00 p.m.
