We have heard Shri T.A. Mirza, learned APP for the applicant.

Two co-accused viz. Murli and Kishor are convicted by the trial Court under Section 302 and 149 of Indian Penal Code.

Murli has filed Criminal Appeal No. 225 of 2016 challenging that conviction and it is admitted for final hearing.

In this situation, we grant leave as prayed for. Criminal Appeal filed by the State Government against the acquittal of the respondent - Virendra is admitted for final hearing.

Action under Section 390 of Code of Criminal Procedure.

To be listed along with Criminal Appeal No. 225 of 2016.
