NOVEMBER 18, 2025 1) Heard learned counsel for the respective parties. 2) The present petition is filed by the petitioners thereby, assailing the order dated 28/12/2018 passed by the Additional Commissioner, Amravati in Revision No.158/RTS-64/Pophali/ 2016-17, whereby the Additional Commissioner rejected the revision of the petitioners and confirmed the order dated 05/12/2016 passed by Additional Collector in Appeal No.RTS/64/44/2015-16.

3) Learned counsel for the petitioners submits that the respondent No.3 Sub Divisional Officer, Umarkhed, District Yavatmal has rightly passed an order rejecting the application for condonation of delay. Before the Additional Collector some additional documents were placed on record, and relying on those documents, Additional Collector has condoned the delay and same was also confirmed by the Additional Commissioner, therefore, relying upon the new record, Additional Collector ought not to have consider the same at appellate stage. 2 08-wp 2268.2019.odt 4) I have gone through the findings recorded by the Additional Commissioner and Additional Collector. As far as delay is concerned, the authorities are required to take liberal approach while condoning the delay. On perusal of the orders passed by the authorities, I find that both the appellate authorities have taken liberal approach while considering the delay. Therefore, I do not find any reason to interfere with the order passed by Additional Collector. Accordingly, the present petition is dismissed. No order as to costs. (SIDDHESHWAR S. THOMBRE, J.) KOLHE
