The applicant has filed this application to transfer the petition filed by the non-applicant for restitution of conjugal rights pending before the Court of 4th Jt. Civil Judge (Senior Division) and ACJM Nagpur to the Court of Civil Judge, (Senior Division), Wardha as the applicant is residing at Seloo. Seloo is about 6 to 7 km away from Wardha. The applicant has also filed two petitions, one for maintenance and another under the provisions of Domestic Violence Act, 2005 at Wardha and it is informed that the non-applicant is attending the said proceedings at Wardha. As the applicant is residing with her daughter who is 3 years of age with the applicant's parents, it will not be convenient for her to incur expenses and travel along with her daughter for attending the proceedings at Nagpur. Hence it is prayed that the aforesaid petition pending in the Court at Nagpur be transferred to the Court of Civil Judge (Senior Division), Wardha. 2.

Though served, the non-applicant has failed to appear before the Court.

Considering the inconvenience of the applicant who is wife of the non-applicant and who is residing with her daughter of 3 years of age at Seloo, the Marriage Petition No.524/2022 pending before the 4th Jt. Civil Judge, Senior Division and ACJM Nagpur, Nagpur (Urban), Nagpur is transferred to the Court of Civil Judge, Senior Division, Wardha.
