Learned counsel for the applicant has pointed out the order dated 5th December, 2014 passed by learned Additional Sessions Judge-4, Nagpur, below Exh.2 in Sessions Trial No. 425 of 2014, and contended that the persons released on bail by names Sheikh Nashir Sheikh Vajir [Accused No.4] and Sheikh Nazir @ Annu Sheikh Vajir [Accused No.5] stand on the same pedestal as the applicant. I have perused this document and the FIR and I think the following order should meet the ends of justice:-
O R D E R
[a] Criminal Application No. 219 of 2015 is allowed to be withdrawn with liberty to file a fresh application before Trial Court.
[b] The Trial Judge shall consider and decide, within four weeks from today, the application, if filed, in accordance with law and in the light of the order dated 5th December, 2014 passed below Exh.2 in Sessions Trial No. 425 of 2014, by which two persons were released on bail Judge |hedau|
