Heard Shri B.W.Patil, advocate for the applicant and Shri S.S.Doifode, A.P.P. for the non-applicant. The applicant apprehends arrest in crime registered against him for the offence punishable under Sections 295(A), 153(A) and 188 of the Indian Penal Code, Section 135 of the Maharashtra Police Act and Sections 14 and 15 of the Press Registration Act.

The applicant is Desktop Publishing Operator carrying on business of Printing Press. The accusations against the applicant are that he printed pamphlets containing objectionable material because of which the religious sentiments of the public at large, and particularly of a community are hurt.

The applicant has filed affidavit pointing out that he has got published his sincere apology in one of the leading newspapers of the city on front page of the newspaper along with the photo of the applicant.

2 aba181.16 Considering the facts on record, that the applicant has not been involved in any crime earlier and as the nonapplicant has not been able to show that the custody of the applicant is required for further investigation, in my view, the interim order granted on 23rd January, 2016 is required to be confirmed.

Hence, the following order :

In the event of arrest in Crime No. 3054 of 2016, registered by the non-applicant, the applicant be released on bail on furnishing P.R. Bond for Rs.Ten Thousand. The application is allowed in the above terms. JUDGE RRaut..
