Heard the learned counsel for the applicant. Perused the contents of the application.

For the reasons stated in civil application, the delay in filing the restoration application is condoned subject to payment of costs of Rupees Five Hundred to the High Court Bar Association, Nagpur. So also, for the reasons stated in the miscellaneous civil application, we allow the application and set aside the order dismissing the petition in default against the respondent no.3 subject to payment of costs of Rupees Five Hundred to the High Court Bar Association, Nagpur.

It is made clear that the applicant would be required to pay the costs of Rupees One Thousand in all within a period of three days.

If the costs are paid by the applicant, issue notice of final disposal to the respondent no.3, returnable on 16.04.2016. Service by Speed Post and Registered Post Acknowledgment Due in addition to the regular mode of service is permitted.

Both, the civil application and the miscellaneous civil application are allowed in the aforesaid terms and disposed of. JUDGE JUDGE APTE
