DATE: 20.09.2022 The learned counsel for applicants - accused and the learned counsel for the non-applicant 2 - complainant jointly state that the matrimonial dispute is amicably settled. 2.

The learned counsel have placed on record memorandum of understanding for dispute resolution purportedly executed on 24.7.2022. The same is marked Exhibit-A.

Non-applicant 2 Dr. Sonali w/o. Vijay Batra has further filed on record affidavit dated 16.9.2022, paragraph 3 of which reads thus:

"3. REPLY AS TO PARA NO. 8 :The content of this para are true that in pursuance of the registration of the First Information Report, the proceedings of the Respondent No. 1 may be stayed till quashing of this instant Petition. The Petitioner had signed the MOU and matter is amicably settled and the Respondent will withdraw all the cases filed

The Applicant's had committed wrong with the Non-applicant No. 2 but in the present scenario both the parties are staying together thus this Hon'ble Bench may allow the quashing Application and the Application be quashed, the N.A. 2 have no objection if the instant Application is allowed."

Considering that the husband and wife are residing together, we accept the prayer for quashment of Crime 073/2021, registered at Bajaj Nagar Police Station, Nagpur, District Nagpur, for offence punishable under section 498-A read with section 34 of the Indian Penal Code.

This order shall come into effect only after the applicants and the non-applicant 2 deposit Rs.20,000/- (Rupees Twenty Thousand) each in the Registry of this Court within the next four weeks.

If the amount is deposited within the next four weeks as aforestated, the proceedings shall stand quashed. The amount deposited shall then be transferred to the account of the Police Welfare Fund, Nagpur City, Nagpur.

If the amount is not deposited within the next four weeks, this application be listed on board under the caption 'directions'.
