(2) The applicant was arrested in Crime No.74 of 2020 for the offence punishable under Section 306 of the IPC. The allegations as revealed from F.I.R. can be summarized that the applicant was having love affair with deceased girl since 3 years prior to her suicidal death. The father of the deceased girl has stated that since he disapproved for marriage proposal, he desisted his daughter from continuing her relations with the applicant. The F.I.R. discloses that the deceased herself informed to her father that from long time she had no communication with the accused. However, the informant again alleged about harassment meted out by the applicant to the deceased. No specific instances of harassment are spelt out. Prima facie there appears to be inconsistency in the statement itself.
907 ba301.20.odt According to the informant, on the date of occurrence the applicant allegedly met deceased at her working place however no material has been produced to satisfy that there has been consistent insistence on the part of applicant, which can be termed as sufficient instigation to commit suicide.
(3) Already this Court by exercising its discretion has released the applicant on interim bail vide order dated 15.04.2020. There is no complaint that applicant has misused his liberty. Inasmuch as, I do not find any compelling reason to take out the liberty which was once granted. Already applicant has faced custodial interrogation. The purpose would be served by issuing certain direction to the applicant to facilitate the investigation.
(4) In view of above, the application stands allowed. The interim order dated 15.04.2020 is hereby made absolute on the same terms and conditions with modification to observe the condition of attendance till filling of chargesheet. (5) The application stands disposed of.
