The applicant apprehends arrest in crime registered against him for the offence punishable under Section 420 of the Indian Penal Code. The crime is registered against the applicant on the complaint filed by Shri Sunil Chavan alleging that the applicant who is President of a society administering education institution, had taken Rs.3,00,000/- from him assuring job in the education institution. It is alleged that the applicant had taken amount of Rs.50,000/- in first week of August, 2010, Rs.2,00,000/- in August, 2010 and Rs.50,000/- on 26th September, 2010. It is alleged that inspite of taking the amount, the complainant was not permitted to work in the institution and the amount taken by the applicant is also

2 aba184.16 not repaid. The complaint about the alleged incident of 2010 is filed in 2015.

Considering the nature of accusations, the facts on the record and as the non-applicant has not been able to show that the custody of applicant is required for further investigation, in my view, the interim order granted by this Court on 23rd March, 2016 is required to be confirmed.

Hence, the following order:

(i) In the event of arrest in Crime No.504/2015 registered by the non-applicant, the applicant be released on bail on furnishing P.R. Bond for Rs.20,000/- (Rs. Twenty Thousand Only). (ii) The application is allowed in the above terms. CRIMINAL APPLICATION (APPP) NO.393/2016 In view of disposal of main application, this application does not survive and is disposed of accordingly.
