The petitioners have filed the public interest litigation contending that various irregularities and illegalities are committed by respondent no.3 and in spite of the representations made in that regard, no steps are taken by the authorities.

It appears that the complaints of the petitioners pertain to the two departments, one is the Education Department and the other regarding Food Supplies Department.

Insofar as the complaint pertaining to the matters coming under the jurisdiction of the Education Department is concerned, an affidavit has been filed by Shri Sanjay Manikrao Yadgire, Education Officer (Secondary), Zilla Parishad, Amravati stating therein that detailed inquiries were made in respect of the allegations made by the petitioners and upon an inquiry, nothing was found in the matter. It has been categorically stated that petitioner no.2 is in the habit of

PIL16-10.odt threatening the officers of self immolation and committing suicide by consuming poison.

Insofar as the complaint pertaining to the matters coming within the jurisdiction of the Food Supplies Department is concerned, the allegations appeared to be pertaining to irregularity in terms of Midday Meals Scheme. In the affidavit dated 30th July, 2011 filed by Shri R.R. Chandurkar, District Supply Officer, Amaravati, it is categorically stated that the departmental inquiry was conducted into the allegations and in the inquiry, respondent no.3 was found guilty. It has been stated that in the departmental inquiry, a penalty in the tune of Rs.55,748/- was imposed upon respondent no.3.

In that view of the matter, we find nothing survives in the petition and the same is disposed of accordingly.
