The learned Counsel Mr. Mahesh Rai makes a solemn statement on instructions that applicant 1Dhananjay s/o Pundalik Patil-Tikar shall surrender before the Investigating Officer on or before 07-5-2021. 3.

The application is disposed of to the extent of applicant 1- Dhananjay s/o Pundalik Patil-Tikar. 4.

In so far as applicant 2-Chaitanya @ Chetan s/o Ramrao Patil-Tikar is concerned, the report does not attribute any direct participation in the assault although it is alleged that applicant 2-Chaitanya @ Chetan s/o Ramrao Patil-Tikar was present armed with sword.

Considering the role attributed and the fact that as regards the same incident there are rival versions and cross-reports, applicant 2-Chaitanya @ Chetan s/o Ramrao Patil-Tikar is entitled to pre-arrest protection. 6.

The interim pre-arrest protection granted to applicant 2-Chaitanya @ Chetan s/o Ramrao Patil-Tikar vide order dated 23-4-2021 is made absolute with the only modification that he shall attend the concerned police station on 5th and 6th May, 2021 from 10-00 a.m. to 4-00 p.m. and shall make himself available to the Investigating Officer, and thereafter shall attend the concerned police station as and when required, till the filing of the charge-sheet.
