The applicant is facing the prosecution in Crime No.374/2019 for offences punishable under Section 376(a) (b) of the Indian Penal Code and under Section 5(m) and 6 of the POCSO Act.

The age of the victim is 4 years and three months only. The medical evidence shows that there is rupture to her hymen.

When the Court was about to dismiss the application, learned counsel for the applicant submitted that .....2/-

The criminal application is dismissed as withdrawn.

Since learned counsel for the applicant is withdrawing the application, the Court is not giving detailed reasons as to why the application needs dismissal. JUDGE !! BRW !!
