While directing issuance of notice to the respondent, by order dated 12th April 2019, this Court granted interim order in favour of the petitioner, however, on condition that the petitioner shall deposit Rs.1,50,000/- with the Registry of this Court within four weeks. Office note shows that the petitioner has not supplied copy of writ petition and, therefore, notice is not issued to the respondent. Advocate for the petitioner has filed pursis Stamp No.7289/2019 stating that the petitioner is not giving instructions. Advocate for the petitioner has sought permission to withdraw the vakalatnama. Office note further shows that the petitioner has not deposited the amount of Rs.1,50,000/- as per the order dated 12th April, 2019.

The facts on record show that the petitioner is not interested in prosecuting the matter. Hence, writ petition is dismissed with costs quantified at Rs.10,000/-

2 wp2247.19 to be deposited by the petitioner with the High Court Legal Services Sub-Committee, Nagpur. The petitioner shall deposit the amount of costs within one week, failing which the Registrar (J.) shall take steps to recover the amount of costs from the petitioner.
