The petitioners' learned counsel would submit that since the challenge is to the rejection of plaint in terms of Order VII Rule 11 sub-clause- (a)(d) of the Code of Civil Procedure, the appeal would lie. 3.

In view of that, learned counsel for the petitioners seeks permission for withdrawal with liberty to file the appeal and to raise all contentions in the appeal.

In view of the above, the writ petition stands disposed of with liberty as prayed.
