Heard learned counsel for the rival parties.

The First Information Report is registered against the applicant under the provisions of the Prevention of Corruption Act. The allegations are that the applicant having taken bribe money, ran away on the motorcycle which was already with him. The learned counsel for the applicant vehemently argued that the applicant has been cooperating with the investigating machinery and, therefore, there is no need to have applicant arrested in the crime in question.

The parameters in the matter of grant of anticipatory bail do not depend upon the submissions

aba177.15 made by learned counsel for the applicant about he having attended police station or as the case may be. The applicant is Head Constable working with Police and thus looking to the material on record, there is a prima facie evidence against him. That being so, I do not find that extension of relief of anticipatory bail should be continued to the applicant.

I the result, I make the following order.

ORDER

(i) Criminal Application (ABA) No. 177/2015 is rejected reserving liberty in favour of the applicant to apply for regular bail.
